Second marriages & step-families

Blended Families.

The default outcome in most states, if you die married and leave a simple will, is that your surviving spouse can rewrite it and disinherit your children — legally, quietly, and permanently. A blended-family plan makes that outcome impossible while still taking care of the person you love.

The trap

A will your spouse can rewrite is not a plan.

Almost every blended-family disaster starts the same way: a spouse dies, leaves everything to the survivor "and trusts them to take care of the children," and the survivor — usually with the best of intentions — later remarries, updates their will, or simply names their own children as sole heirs. The biological children of the first spouse get nothing, and there is no court that will unwind it. The fix is structural, not emotional.

The blended-family stack

  • QTIP or bypass trust — spouse for life, children after
  • Home held in trust or life estate, not joint tenancy
  • Beneficiary audit — no ex-spouse still named on a 401(k)
  • Retitle accounts so nothing passes by default alone
  • Separate-share trust for children of prior relationship
  • Prenup and estate plan reconciled in one review

Common failure modes we prevent

  • Surviving spouse rewrites the will
  • Ex-spouse still named on retirement or insurance
  • Home sold by survivor with proceeds leaving the family
  • Equal treatment of biological and stepchildren by default
  • Prenup that contradicts the will
  • No plan for stepchildren the deceased raised but never adopted
The conversation

The families that talk once don't litigate later.

The single strongest predictor of a peaceful transition in a blended family isn't the trust language — it's whether the family had one honest conversation while the parents were alive. We facilitate it, on the record, once, in a way that removes the "we never talked about it" fight before it starts. Optional, and often the most valuable part of the engagement.
